Política de tratamiento de datos personales

En corto: uso tus datos solo para responder tu brief y trabajar contigo en tu proyecto. No los vendo ni los uso para publicidad. Si no llegamos a un acuerdo, se borran automáticamente a los 12 meses, y puedes pedir que los borre antes escribiendo a [email protected].

Esta política se rige por la Ley 1581 de 2012 y el Decreto 1074 de 2015 (que compila el Decreto 1377 de 2013) de Colombia. Para visitantes de la Unión Europea también se tiene en cuenta el Reglamento General de Protección de Datos (RGPD).

02Qué datos recojo

Cuando envías el brief (/brief/):

• Contacto: nombre, empresa o marca y número de WhatsApp o email.
• Proyecto: tus respuestas sobre objetivo, plataforma, estilo, plazos, referencias y enlaces.
• Archivos que decidas subir (referencias o material del proyecto).
• Datos técnicos del envío: país aproximado según tu dirección IP, tipo de navegador y fecha y hora.
• Verificación anti-spam: Cloudflare Turnstile revisa señales técnicas de tu navegador para comprobar que no eres un bot.

Cuando navegas por el sitio:

• Tu navegador guarda tu preferencia de idioma (almacenamiento local) y, mientras llenas el brief, un identificador temporal de la subida de archivos que se borra al cerrar la pestaña.
• No uso cookies propias de publicidad ni de seguimiento. Puedo usar estadísticas de visitas agregadas y sin cookies (Cloudflare Web Analytics), que no te identifican.
• Cloudflare, como proveedor de infraestructura y seguridad, puede usar cookies técnicas estrictamente necesarias, por ejemplo para la protección contra bots.

Si me escribes por email o WhatsApp, trato lo que compartas en esa conversación con las mismas finalidades. No pido datos sensibles (salud, origen, creencias, datos biométricos, etc.): por favor no los incluyas en el brief ni en los archivos.

03Para qué los uso

• Leer y responder tu brief y enviarte una propuesta.
• Comunicarme contigo por el canal que elegiste.
• Si me contratas: hacer el proyecto, entregarte los archivos, facturar y cumplir obligaciones legales y contables.
• Proteger el sitio contra spam y abusos.

No vendo, alquilo ni cedo tus datos, y no te enviaré publicidad sin pedirte permiso por separado.

Base legal (RGPD): tu consentimiento al enviar el brief, las medidas previas a un contrato que tú pides y el interés legítimo en mantener el sitio seguro.

04Tu autorización

Al marcar la casilla de aceptación del brief me das tu autorización previa, expresa e informada para tratar tus datos como se describe aquí. Guardo prueba de esa autorización (versión de esta política, idioma y fecha). Puedes revocarla cuando quieras (ver secciones 07 y 08).

05Con quién se comparten y transferencias internacionales

• Cloudflare, Inc. (EE. UU.): alojamiento del sitio, almacenamiento de briefs y archivos, envío del correo de aviso y verificación Turnstile.
• Google LLC (EE. UU.): recibo el aviso de cada brief en una cuenta de Gmail.
• WhatsApp / Meta, solo si decides escribirme por ahí.
• Autoridades, cuando la ley me obligue.

Estos proveedores están fuera de Colombia, así que tus datos pueden guardarse en servidores en el exterior. Al aceptar esta política autorizas esa transmisión internacional. Solo comparto lo necesario para cada servicio y nunca con fines comerciales de terceros.

06Cuánto tiempo los guardo

• Briefs y archivos subidos: se borran automáticamente a los 12 meses del envío.
• Si trabajamos juntos: conservo lo necesario del proyecto y de la facturación durante el tiempo que exijan las normas contables y tributarias.
• Puedes pedirme que los borre antes, salvo lo que deba conservar por ley.

07Tus derechos

Según la Ley 1581 de 2012 puedes:

• Conocer, actualizar y rectificar tus datos.
• Pedir prueba de la autorización que me diste.
• Saber qué uso les doy.
• Revocar la autorización o pedir que los borre.
• Acceder a ellos de forma gratuita.
• Presentar quejas ante la Superintendencia de Industria y Comercio (SIC), después de hacer primero la consulta o el reclamo conmigo.

Si estás en la Unión Europea o el EEE, además tienes derecho de acceso, rectificación, supresión, oposición, limitación y portabilidad, y a reclamar ante tu autoridad de protección de datos.

08Cómo ejercer tus derechos

Escribe a [email protected] con el asunto "Datos personales". Indica tu nombre, el WhatsApp o email que usaste en el brief y qué necesitas. Puede que te pida confirmar tu identidad.

• Consultas: respondo en máximo 10 días hábiles. Si no alcanzo, te aviso el motivo y respondo en máximo 5 días hábiles más.
• Reclamos (corregir, actualizar, borrar o revocar): respondo en máximo 15 días hábiles. Si no alcanzo, te aviso el motivo y respondo en máximo 8 días hábiles más.

09Seguridad

El sitio usa conexión cifrada (HTTPS), verificación anti-bots y acceso restringido a los datos. Ningún sistema es 100 % seguro: si ocurriera un incidente que afecte tus datos, te avisaré y lo reportaré a la SIC cuando corresponda.

10Menores de edad

Los servicios están dirigidos a mayores de 18 años. Si eres menor, pide a tu madre, padre o representante legal que envíe el brief por ti.

11Cambios en esta política

Si cambio esta política, publicaré aquí la nueva versión con su fecha. Si el cambio afecta a las finalidades, te pediré de nuevo tu autorización.

In short: I only use your data to reply to your brief and work with you on your project. I don't sell it or use it for advertising. If we don't end up working together, it is deleted automatically after 12 months, and you can ask me to delete it sooner by writing to [email protected].

This policy is governed by Colombian Law 1581 of 2012 and Decree 1074 of 2015 (which compiles Decree 1377 of 2013). For visitors from the European Union, the General Data Protection Regulation (GDPR) is also taken into account.

02What data I collect

When you send the brief (/brief/):

• Contact: name, company or brand, and WhatsApp number or email.
• Project: your answers about goals, platform, style, timing, references, and links.
• Files you choose to upload (references or project material).
• Technical data of the submission: approximate country based on your IP address, browser type, and date and time.
• Spam protection: Cloudflare Turnstile checks technical signals from your browser to confirm you are not a bot.

When you browse the site:

• Your browser stores your language preference (local storage) and, while you fill in the brief, a temporary file-upload identifier that is cleared when you close the tab.
• I don't use my own advertising or tracking cookies. I may use aggregated, cookie-free visit statistics (Cloudflare Web Analytics) that don't identify you.
• Cloudflare, as the infrastructure and security provider, may set strictly necessary technical cookies, for example for bot protection.

If you write to me by email or WhatsApp, I handle what you share in that conversation for the same purposes. I don't ask for sensitive data (health, origin, beliefs, biometrics, etc.): please don't include it in the brief or in your files.

03What I use it for

• Reading and replying to your brief and sending you a proposal.
• Contacting you through the channel you chose.
• If you hire me: doing the project, delivering files, invoicing, and meeting legal and accounting obligations.
• Protecting the site against spam and abuse.

I don't sell, rent, or hand over your data, and I won't send you marketing without asking for separate permission.

Legal basis (GDPR): your consent when you send the brief, pre-contract steps you request, and a legitimate interest in keeping the site secure.

04Your authorization

By ticking the consent box in the brief, you give prior, express, and informed authorization to process your data as described here. I keep proof of that authorization (policy version, language, and date). You can withdraw it at any time (see sections 07 and 08).

05Who it is shared with, and international transfers

• Cloudflare, Inc. (USA): site hosting, storage of briefs and files, notification email delivery, and Turnstile verification.
• Google LLC (USA): I receive the notice of each brief in a Gmail account.
• WhatsApp / Meta, only if you choose to message me there.
• Authorities, when the law requires it.

These providers are outside Colombia, so your data may be stored on servers abroad. By accepting this policy you authorize that international transfer. I only share what each service needs, and never for third-party commercial purposes.

06How long I keep it

• Briefs and uploaded files: deleted automatically 12 months after submission.
• If we work together: I keep what is needed from the project and invoicing for as long as accounting and tax rules require.
• You can ask me to delete it sooner, except what I must keep by law.

07Your rights

Under Colombian Law 1581 of 2012 you can:

• Know, update, and correct your data.
• Ask for proof of the authorization you gave.
• Be told how your data is used.
• Withdraw your authorization or ask for deletion.
• Access your data free of charge.
• File a complaint with the Superintendence of Industry and Commerce (SIC), after first making your request to me.

If you are in the EU or EEA, you also have the rights of access, rectification, erasure, objection, restriction, and portability, and the right to complain to your data protection authority.

08How to exercise your rights

Write to [email protected] with the subject "Personal data". Include your name, the WhatsApp or email you used in the brief, and what you need. I may ask you to confirm your identity.

• Questions: answered within 10 business days. If I need more time, I'll tell you why and reply within 5 more business days.
• Claims (correct, update, delete, or withdraw): answered within 15 business days. If I need more time, I'll tell you why and reply within 8 more business days.

09Security

The site uses encrypted connections (HTTPS), bot protection, and restricted access to the data. No system is 100% secure: if an incident affects your data, I will let you know and report it to the SIC when required.

10Minors

The services are meant for people over 18. If you are a minor, ask your parent or legal guardian to send the brief for you.

11Changes to this policy

If I change this policy, I'll publish the new version here with its date. If the change affects the purposes, I'll ask for your authorization again.
